Minnesotans Against Fraud and Higher Insurance Costs
A growing coalition, called Minnesotans Against Fraud and Higher Insurance Costs is working to convince the Legislature to reject these ill-conceived bills. Minnesotans Against Fraud and Higher Insurance Costs is a broad-based coalition of consumers and taxpayers, businesses and civic groups. The group aims to send a strong message to the Legislature that consumers deserve to be protected from fraud, higher insurance costs and frivolous lawsuits. These Double Lawsuit bills were written by personal injury lawyers for the sole benefit of personal injury lawyers. If passed, these bills will result in a massive increase in the number of lawsuits filed, drastically increase costs for consumers and their insurance companies and give personal injury attorneys double the chance to win big fees on a single case. The consequences of these bills are far reaching and will affect every policyholder in Minnesota causing higher costs for virtually ALL lines of insurance, including auto, homeowners, general liability, etc. Good drivers will be punished as their insurance rates rise, even if no claim is filed. In fact, when similar law was in effect in California (it was later reversed by the California Supreme Court and then rejected by voters), a California study showed that these types of laws can drive up auto insurance premiums as much as 14.5 percent. Homeowners will face higher costs and an increased threat of lawsuits for such a thing as an accident on their property.
A very common example that can happen anytime that can initiate double lawsuit bills:
You are a homeowner and a neighbor is invited onto your property and slips and injures themselves. That neighbor might then hire a personal injury attorney to sue you for damages. Your insurance company steps in to assess the injury and may offer to cover the medical bills for the injured party as well as pay for pain and suffering.
However, under these proposed laws, instead of accepting the settlement, the other party’s attorney sees an opportunity to get more money and they file two separate lawsuits (one against you and another one against your insurance company) costing far more than what the insurance company deemed to be fair based on its investigation. These extremely costly, multiple lawsuits provide powerful incentives for filing frivolous lawsuits or fraudulent claims. The only real benefit goes to the lawyers who stand to gain much higher attorney fees.
Virtually every insurance policyholder in Minnesota will suffer the negative consequences of these self-serving bills. Written by personal injury lawyers to benefit themselves, these laws would allow two separate lawsuits for a single claim. The lawyers behind or supporting these bills stand to make millions of dollars by threatening to file multiple lawsuits, forcing consumers and their insurance companies into huge out-of-court settlements to avoid lengthy and expensive litigation.
This will drastically raise insurance costs for everyone and increase the number of lawsuits filed in our already strained court system. Minnesota consumers deserve better and should demand that legislators reject these bills.

Online Business – Optimizing Your Site to Get Top Billing at Search Engines
When a user enters a search term, also known as a ‘keyword,’ into a search engine, the engine runs through the billions of pages in the database and awards each one a ‘relevancy score.’ The higher your score, the higher your listing. If your site doesn’t contain the keyword used by the searcher, the only score it’s going to get is a big, fat zero. Your first task then is to make sure you know which keywords are most relevant for each of your sites.
There are three ways to figure out your keywords:
Ask your competitors
This is the cheapest way to find many of the most important keywords. Simply log on to a search engine (AltaVista is good, Google is better) and carry out a search for sites like yours. Open the top site, and once the home page has downloaded, click on ‘View’ in your browser, and then ‘Source.’ That will reveal all the HTML used to build the Web page, including all the keywords that have been specially inserted.
For example, let’s say one of your websites sold nutritional supplements. You could carry out a search for ‘vitamins’ in Google. The top site there is called DrugEmporium.com, and the keywords they list are “The Katz group, Snyders, Drug Emporium, Drug, Drug Store, pharmacy, stores.”
Some of those keywords will be relevant to your site. Others, of course, won’t be relevant and there will be lots of other keywords that aren’t obviously listed–like ‘vitamins’ for example. But you can repeat the process on other sites, using different keywords, and build up a pretty long list.
Ask the pay-per-clicks
Pay-per-click sites actually let you see how popular a keyword is. They’re not being kind; they’re trying to make money. The more webmasters bid on those keywords, the higher the bids are going to rise–and the more money the pay-per-clicks are going to make. FindWhat, for example, has a Keyword Center, and Overture a Keyword Suggestion Tool. Both are very handy, but they also require you to open an account. That can cost a few bucks, but when you have a lot of sites covering a lot of different areas, it’s usually worth the expense.
Use a specialized tool
Not too surprisingly, a number of companies have popped up to supply specific keyword services for a fee. The best of these is WordTracker.com. They’re not bargain basement, but you get what you pay for. They’ll give you all the keywords you need and in my experience, they’re a sound investment.
Googlefight.com is another useful tool to see whether one keyword is more popular than another. The site compares two keywords and tells you which is more popular. It’s free and has a limited use, but it’s fun to play with.
As you make up your list of keywords, bear in mind that it’s also worth looking at key phrases. It’s quite possible that a user looking to buy flowers online might search for ‘red roses’ or ‘cheap bouquets’ as well as just ‘flowers.’ Key phrases are often overlooked by competitors, so you’ve got a pretty good chance of getting a high placement with the right combination.
Don’t worry too much about the competition though. Some people will tell you that you’re better off trying to find keywords that no one else has thought of–as if there were any!–and others will tell you to throw in keywords that are only slightly relevant to your businesses.
In my experience, that’s a waste of time. If your competitors are using certain keywords, it’s because they know they work. And if you pick up any users using irrelevant keywords, you’re not going to sell them anything. Don’t try to reinvent the wheel here: just try to figure out the most popular keywords and the best key phrases to put on your site.
Whichever of these methods you use–and I tend to use more than one–you should end up with a pretty comprehensive list of keywords that you can stick into your website. The next question then, is how do you use them? When a search engine assigns relevancy to a site, it looks for the keywords in a number of specific areas.
Title Tag
The title tag is written in the section of the Web page and after the
That looks long, but the title tag is usually between 50 and 80 characters including spaces. Different search engines have different limits so you want to make sure that your most important words are near the beginning of the title. When you look at the New York Times’ site, you only see “The New York Times on the Web”.
The rest of the title is made up of keywords and phrases but in fact, you don’t want to put in too many keywords here. Just place one keyword as the second or third word in the title. Too many, and your site could be seen as spamming.
You can also list more keywords in the and sections of the area, but because these areas have been so abused in the past, a number of search engines today will skip right past the title tag and go straight to the Web copy.

SEO – The Development of Page Ranking Algorithms
Google, which is the gold standard for all page-ranking systems (including PageRank as it is called by the industry) was started by two Stanford University Students – Sergey Brin and Larry Page (no pun intended.) These two students (now billionaires) invented the Google algorithm now known as PageRank.
All PageRank is really is a formula, not unlike the FICO score that is used to calculate credit. Only in this case the formula takes in a lot of variabilities to see if a page is worthy of being included at the top of search engine rankings. This concept weighs a page’s importance based upon the incoming links. In essence PageRank is a type of prediction, but one that can make a great deal of difference to the credibility of your business. It is the estimation of the likelihood that a given page will be reached by a web user who is randomly surfing the web. This popularity is measured by how an individual might have followed links from one page to another. This of course makes some links more valuable then others and it is your goal as a web master to use SEO techniques to make your links valuable in terms of the PageRank system.
Another genius element of the PageRank algorithm is that it keeps link results relevant to what the person is searching for. The fact that PageRank keeps searches on the Internet accurate (for the most part anyway) has made it the most emulated and popular algorithm in use by search engines today.
Of course the Google PageRank system is not invulnerable to exploitation. There are many ways of fooling the algorithm, usually through the buying and trading of links which is known as white hat SEO. There is also black hat SEO that as mentioned before uses techniques frowned on by Google to boost a web page’s rankings in the search engines.
SEO – Getting into Google and Yahoo
Although SEO experts will make a big deal about optimizing a site sometimes all you really need is a well designed functional site with a good shopping cart, accurate articles and descriptions of your products and services on the site and a good niche product that is sold at an affordable price. All of the SEO in the world will not sell a lousy overpriced product from a website that is not secure in terms of payment and is filled with articles that do not relate to what the site is selling. The more true you are to what you are actually selling, and the more ethical you are about what you are selling the more likely you are to be paid attention to by the big search engine. The truth is that the big search engines such as Yahoo and Google are mutating their algorithms daily to weed out the SEO tricksters from the real thing.
One way that both Yahoo and Google have been weeding out those who try to take SEO shortcuts from those who are serious about their business is to ask for manual submission to their programs. Yahoo is famous for their manual submission program, which not only costs you, but also offers no refund if they decide to reject your site. Google Sitemaps has a similar submission process in which an XML type feed can be created and submitted.
Do you need to go to all this trouble to get listed in the search engines. Generally if your site is good and not an obvious ploy to fool the spider engines or fool people all it takes is a simple link from a site that has already been indexed to improve the page rankings of your web site. In order to do this though you need to convince a big business to be impressed with your site, which is why, SEO nowadays is also about how to improve the functionality and look of your site so it is appealing to others.
SEO – Three Design Elements That Sabotage SEO
When designing your website there are three major design elements that you should stay away from in order as they can sabotage even your best efforts at search engine optimization. These three elements to avoid are flash animation, javascript and HTML coding mistakes.
First of all, search engines perceive sites with flash as being “empty spaces.” Rather than checking out the content, most search engines just discard the URL. God knows how many people’s sites have been rejected because a spider inside a search engine denoted their flash as blank space!
If you are using Javascript or CSS in your pages, you probably stuck it at the top of your pages. Remember that search engines tend to rate what they find at the top of pages a bit higher so avoid anything that a search engine considers to be fluff — and that would be pages and pages of Java enabled script. A better way to do things is put the Javascript (or CSS) in a separate file, and include it into your pages with a single tag. To avoid this kind of headache however, I advise that you avoid using java script at all. The worst thing that can happen is that a search engine spider will read the javascript as a malfunctioning page. It happens all the time!
It is also crucial to make sure your HTML is correct. Just because your page is displaying nicely does NOT mean that the code itself doesn’t contain errors. Search engines read HTML not what shows up on you pretty pages. The more perfect your HTML code is, the more likely a search engine is to rank it higher. This is why it might be a practical part of an SEO strategy to hire an expert to clean up your code if it is all messed up.
Plan Implementation And Control
The basic strategy planning concepts are enduring and will always be at the heart of marketing. Manager who can quickly adjust the details of his efforts to better solve customer problems or respond to changes in the market can do better job for his firm because he can make certain that his plans are really performing as expected.
Whether implementation decisions and activities are internal or external, they all must be consistent with the objectives of the overall strategy with the other details of the plan. There are three general objectives that apply to all implementation efforts. Other things equal, the manager wants to get each implementation job done: Better. Faster. At lower cost.
So, it’s important to be creative in looking for better solutions to implementation problems. That may require finding ways to better coordinate the efforts of the different people involved, setting up standard operating procedures to deal with recurring problems, or juggling priorities to deal with the unexpected.
Sales Analysis a detailed breakdown of a company’s sales records can be very informative. Detailed data can keep marketing executives in touch with what’s happening in the market. In addition, routine sales analyses prepared each week, month, or year may show trends and allow managers to check their hypotheses and assumptions.
There is no one best way to analyze sales data. Typical breakdowns include:
1. Geographic region country, state, city, sales rep’s territory.
2. Product, package size, grade, or color.
3. Customer size.
4. Customer type or class of trade.
5. Price or discount class.
6. Method of sale. mail, telephone, or direct sales.
7. Financial arrangement cash or charge.
8. Size of order.
9. Commission class.
The marketing audit is a systematic, critical, and unbiased review and appraisal of the basic objectives and policies of the marketing function and of the organization, methods, procedures, and people employed to implement the policies. A marketing audit requires a detailed look at the company’s current marketing plans to see if they are still the best plans the firm can offer. A marketing audit takes a big review of the business and it evaluates the whole marketing program. It might be done by a separate department within the company perhaps by a marketing controller. But to get both expert and objective evaluation, it’s probably better to use an outside organization such as a marketing consulting firm.
Keyword Laddering – A Concept to Success with the Search Engines
Getting traffic from the search engines for a popular search term is very difficult. There is a lot of competition. Keyword laddering is a way to make it happen.
If your efforts in developing web traffic focus on keywords you know it is very difficult to get ranking in the search engine for very popular (and very high paying) keywords. A search of your keyword will reveal tens of thousands of other sites and millions of other pages that you have to compete with. So how do you establish your site as an important site that people should visit?
You do this by not going after the main keyword immediately. You should first establish your site as an expert site in the general realm of your chosen keyword. Let me explain.
Let’s say you have a site that focuses on Fantasy Books. If you do a search engine check of this term you are literally going to get ten million results! To move your site up in this enormous listing of sites you have to establish your site as an expert in the area and to do this you ladder your way up the keyword phrases. Here is how to do it.
Using a keyword selection tool like Overture, Google keywords, or Word tracker find extremely long keyword phrases. Something like: “What is a good fantasy book to read?” Then write content that is extemely focused and solves that question really well. Give the web browser the absolute best answer to that question. When you are using a very long search term like this your keyword tool might only report that it gets fifty or a hundred hits a month but that’s ok. Because this search term is low traffic you will be able to quickly get a good ranking with it – there is much less competition. The traffic you do get will be very targeted, and very happy because you very specifically solved a search need and the search engines will take notice of this.
You should do dozens, and if possible hundreds of pages that do this kind of very focused search term problem solving. And from there you ladder yourself up to the more valuable, higher traffic, shorter keyword phrases. Something like: “the best fantasy book” would be good. Eventually, over time, you focus on your highest value keyword like in the case of this article “fantasy books”.
This approach is not the fast way to do it. It is all about establishing expertise with your chosen subject area and for it to achieve maximum results you should always try to find long keyword terms that include your ultimate keyword and always write the best stuff you can that really solves a searchers problem. This will establish you as an expert with the keyword and give the search engines reason to rank your site high.

A Christmas Of Good Intentions
If the Christ child had been born in a mall instead of a manger, we would not be celebrating Christmas today. The Three Wise Men would have never found a place to park. Then again, everyone knows you won’t find a wise man in a mall parking lot a week before Christmas. That trip into holiday hell is left to lesser-thinking men. Men like me.
You see, I’ve always been one of those “wait till Christmas Eve, then grab the first thing you see and hope they like it” kind of shopper. A last-minute-man, that’s what I am. But this year was going to be different. This year I was going to shop… dare I say it… early.
I was very proud of myself at first, going shopping an entire week and a half before actually having to produce the gifts. To be totally honest, it was my wife who insisted that I venture out early this year. Never a big fan of what she calls my “desperation method of shopping,” she put her foot down last year after I presented her with a “Braun Nose Hair Trimmer 2000″ and a lovely set of “Elvis Presley’s Love Me Tender” sheets and pillow cases. I still don’t understand what she was so upset about. That nose hair trimmer does a fine job of shaving the fuzz off her sweaters and every woman wants to sleep with The King… at least that’s what the label said.
Independent surveys have shown that as a last minute shopper, I am not alone. One study conducted by the South Hampton Institute of Technology’s Hammond-Egger Anthropological Department concluded that:
“…the tendency to put off gift shopping until the last possible minute is exhibited primarily by the male of the species. Individual case studies, as well as a number of autopsies performed on men who were run down in mall parking lots on Christmas Eve, suggest that this penchant for postponing purchasing is caused by the same hormone that makes men hesitant to dance in public, hug their mother-in-law and admit that they thought “Terms of Endearment” was a pretty decent film. Scientifically speaking, it’s a guy thing.”
So there I was last Saturday afternoon, almost two weeks before the big day, cruising the mall parking lot with a thousand other idiots out to prove their wives wrong. Bumper to bumper we crept, inching up one row and down another, as if any of us actually had a prayer of finding a space that didn’t require taking a cab back to the mall. They say the suicide rate rises around the holidays. I’ll bet if they looked into it they would find that most of these poor souls decided to chuck it all after spending a frustrating day driving round and round the mall. It’s enough to drive anyone over the edge.
For a while, I did what everyone else was doing: following pedestrians who were walking through the parking lot in hopes that they were about to vacate a space. This proved to be a fruitless plan because none of these people ever seemed to find their car. I finally figured out why: they were the “I know I parked my car around here somewhere, but danged if I know where” people. These poor saps were even worse off than those of us who couldn’t find a place to park. At least we were inside our nice, warm cars. They were wandering around in the cold like extras from “The Night of the Living Dead.”
Being the quick-thinking, early shopper that I am, I offered to drive one of these zombies around until we found his car if he would give me his space. It proved to be a brilliant plan. Ten minutes later I was parked and walking through the lot toward the mall, a line of cars following close behind.
I have to admit, at this point I was feeling pretty cocky about the whole situation. I had managed to nab a parking space in the same county as the mall, had managed to make it inside the mall without being mugged or run down or assaulted by one of those overzealous bell ringers, and I was going to get my shopping done a full week and a half early.
I was overcome with the spirit of Christmas. Nothing was going to ruin my mood. Nothing.
Then, I stepped into the mall and everything changed.
But that’s another story!
